  • First-degree murder: This offense is committed when a person intends to cause someone's death, and that result is achieved. For an act to be considered first-degree murder, the intended victim must have been a police officer, peace officer, first responder, or jail or prison employee performing their official duties.

A person could also be accused of first-degree murder if:

    • They were incarcerated at the time of the offense;
    • Their victim was a witness to a crime;
    • They agreed to carry out the act for another person in exchange for something of value;
    • The act was done during the commission of another crime;
    • They intended to cause serious bodily injury and death resulted;
    • They tortured their victim before killing them;
    • Within 2 years, killed 2 or more other people in the state;
    • The intended victim was a judge; or
    • The death resulted from an act of terrorism;
  • Second-degree murder: A person commits this offense when they intentionally caused another's death and they acted in a way that showed a disregard for human life, carried out the act during the commission of a violent or sex crime, engaged in reckless conduct that put someone else at risk of serious injury and death resulted, or were 18 years of age or older and killed a person under 14 years of age while committing a sex crime.
  • Aggravated murder: If a person intentionally caused the death of a police officer, peace officer, first responder, or jail or prison employee, they could be charged with aggravated murder.
